No trips over the pass
Everything in your case is handled remotely, from the first call to your discharge:
- Your free consultation is by phone or video call.
- You send your documents through our secure client portal.
- The meeting of creditors is held by Zoom, and we prepare you and attend it with you.
Most Chapter 7 cases never require you to appear in court in person. Your case is filed in the U.S. Bankruptcy Court for the District of Nevada, the same court and the same rules as for someone who lives on the Strip.
Land, vehicles, tools and animals
Life in Pahrump often means more property than a Las Vegas apartment: acreage, a manufactured home, trucks and trailers, work tools, sometimes livestock. Nevada's exemption laws protect a lot of it:
- Your home, including a manufactured or mobile home you live in, is protected by Nevada's homestead exemption. Will I lose my house?
- One vehicle, up to $15,000 in equity. Can I keep my car?
- Tools of your trade and household goods. Will the trustee take my furniture and tools?
Extra vehicles, trailers, vacant land and other property need a closer look before you file. That is exactly the kind of thing a Chapter 7 trustee examines.
Your lawyer has sat in the trustee's chair
Every Chapter 7 case is reviewed by a trustee. Brian D. Shapiro has served as a Chapter 7 trustee in Las Vegas for over 15 years, is currently the longest-serving trustee in Las Vegas, and has administered over 15,000 cases. When he represents you, your case is prepared by someone who knows exactly what the trustee will ask. More about Brian.
Stopping collection in Nye County
The day your petition is filed, the automatic stay generally stops wage garnishments, bank levies, repossessions and collection lawsuits, including cases in Pahrump Justice Court. Child support and alimony are the main exception.
What it costs
Most Chapter 7 cases are a $2,500 flat fee with $0 down in attorney fees: nothing before your petition is filed, then $250 a month starting 30 days after filing. The court's $338 filing fee is paid before filing. How $0 down in attorney fees works.
Other areas we serve
We also represent people in Las Vegas, Henderson, North Las Vegas, Summerlin, Boulder City and Laughlin. We file Chapter 7 cases only, and only in Nevada.
Common questions
Do I have to drive to Las Vegas to file bankruptcy?
No. Your consultation is by phone or video, your documents go through our secure portal, and the meeting of creditors is held by Zoom.
Can I keep my land or my mobile home?
Your home, including a manufactured or mobile home you live in, is protected by Nevada's homestead exemption. Other land and extra vehicles need a closer look, which we do at your free consultation.
Will filing stop a case in Pahrump Justice Court?
Generally, yes. The automatic stay stops most pending collection lawsuits once your petition is filed.
Is the process different because I live in Nye County?
No. Wherever you live in Nevada, your case is filed in the same federal bankruptcy court under the same Nevada exemption laws.
